Sobotka, diagnosed with benign prostatic hypertrophy (BPH), which caused a frequent and uncontrollable need to urinate, found himself in a difficult situation. According to the lawsuit, on February 2, 2022, he urinated in the Zamboni garage, a private area, due to his condition. He was then fired for what the company called "bad judgment."
But here's where it gets controversial... Sobotka's lawsuit alleged that this wasn't just a case of poor judgment but rather age discrimination. He claimed that a vice president had made comments about his age, suggesting that his termination was motivated by his age. The lawsuit further stated that the termination was not due to lack of seniority, merit, quantity, or quality of production, but rather, due to age.
The stakes were high. Sobotka sought compensation for lost earnings and benefits, as well as reinstatement and training for Olympia Entertainment managers.
The legal proceedings unfolded, with the jury ultimately siding with Olympia Entertainment. Sobotka, on his 72nd birthday, expressed his devastation at the verdict. His lawyer, Deborah Gordon, noted the relatively short deliberation time of approximately 40 minutes, compared to the typical four hours in similar cases, raising questions about the jury's decision.
Michael Mitchell, Olympia Entertainment's lawyer, defended the verdict, stating that Sobotka's actions constituted "gross misconduct."
